Violation of any of the above may result in immediate termination of your account, cancellation of pending orders, and potential referral to law enforcement authorities where appropriate. Jet's Pizza reserves the right to pursue all available legal remedies in connection with any violation of these Terms.

5. Ordering, Payment, and Pricing Terms

5.1 Order Placement and Confirmation

All orders placed through pizza-jets.digital constitute an offer to purchase food items at the listed prices. An order is not confirmed until you receive an electronic order confirmation via email or on-screen notification. We reserve the right to refuse or cancel any order at our discretion, including due to pricing errors, product unavailability, or suspected fraudulent activity.

5.2 Pricing and Menu Changes

All prices listed on the Platform are in United States Dollars (USD) and are subject to change without prior notice. Prices may vary depending on your delivery location, applicable taxes, service fees, and delivery charges. Any applicable sales tax will be calculated and displayed at checkout in accordance with applicable state and local tax laws.

5.3 Payment Methods

We accept major credit and debit cards (Visa, Mastercard, American Express, Discover), digital wallets, and other payment methods as displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method and that all payment information is accurate.

5.4 Refunds and Cancellations

All content available on or through the Platform, including but not limited to text, graphics, logos, images, photographs, menu designs, audio clips, video clips, digital downloads, data compilations, software, and the overall "look and feel" of the Platform, is the exclusive property of Jet's Pizza or its content licensors and is protected by applicable United States and international intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act, and applicable trademark and trade dress laws.

The Jet's Pizza name, logo, brand elements, and all associated product names and taglines are trademarks or registered trademarks of Jet's Pizza. You may not use any of our trademarks, logos, or trade dress without prior written permission from an authorized representative of Jet's Pizza.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for the purpose of placing personal, non-commercial food orders and using the features made available to registered users. This license does not include any right to:

• Modify, adapt, translate, or create derivative works based on any Platform content;
• Reproduce, distribute, publicly display, or publicly perform any Platform content;
• Reverse engineer, decompile, or disassemble any software components of the Platform;
• Remove or alter any proprietary notices, labels, or marks on the Platform;

7. Disclaimers and "As-Is" Basis

THE PLATFORM AND ALL CONTENT, SERVICES, PRODUCTS, AND FEATURES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JET'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM, INCLUDING MENU DESCRIPTIONS, NUTRITIONAL INFORMATION, ALLERGEN DISCLOSURES, OR PRICING;
• WARRANTIES THAT ANY DEFECTS OR ERRORS ON THE PLATFORM WILL BE CORRECTED.

Jet's Pizza makes no warranty regarding the quality, safety, or fitness for consumption of any food product ordered through the Platform. Customers with food allergies, dietary restrictions, or medical conditions are strongly encouraged to contact us directly at [email protected] before placing an order. Cross-contamination with allergens may occur in our kitchens, and we cannot guarantee allergen-free preparation environments.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by applicable law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL JET'S PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM OR ITS SERVICES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
• PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE PLATFORM;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
• ANY DELAYS, INTERRUPTIONS, OR ERRORS IN THE TRANSMISSION OF ORDERS OR COMMUNICATIONS;
• ANY FOOD QUALITY OR SAFETY ISSUES BEYOND THOSE COVERED BY APPLICABLE PRODUCT LIABILITY LAW;
• CONDUCT OF ANY THIRD PARTY USING THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO JET'S PIZZA IN THE SIXTY (60) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some states do not allow limitations on implied warranties or exclusion of certain types of damages, so the above limitations may not fully apply to residents of such states. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its respective owners, officers, directors, employees, agents, affiliates, contractors, and licensors (collectively, "Indemnified Parties") from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:

• Your access to or use of the Platform;
• Your violation of these Terms of Service;
• Your violation of any applicable federal, state, or local law or regulation;
• Your infringement of any intellectual property or other rights of any third party;

Subject to the dispute resolution provisions set forth below, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Platform shall be brought exclusively in the federal or state courts of competent jurisdiction within the United States, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Our services are intended for use within the continental United States. We make no representation that the Platform or its content is appropriate or available for use in locations outside the United States. If you access the Platform from outside the United States, you do so at your own risk and are responsible for compliance with applicable local laws.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) calendar days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may pursue the remedies described below.

13.2 Binding Arbitration

Except for claims that may be brought in small claims court, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or our services — including questions about the existence, validity, or termination of these Terms — shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are incorporated herein by reference. The arbitration shall be conducted in English and in accordance with applicable United States federal arbitration law, including the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, except that the arbitrator shall not have the authority to award punitive damages beyond those permitted by applicable law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND JET'S PIZZA EXPRESSLY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER YOU NOR JET'S PIZZA SHALL BE ENTITLED TO CONSOLIDATE CLAIMS OR PARTICIPATE IN ANY CLASS-WIDE ARBITRATION.

13.4 Small Claims Court

Notwithstanding the above, either party may bring qualifying claims in a court of competent small claims jurisdiction within the United States, provided the claim remains in that court and is not removed to a court of general jurisdiction.

14. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you access or use the Platform. Jet's Pizza reserves the right, in its sole and absolute discretion, to:

• Suspend or terminate your access to the Platform, with or without cause and with or without notice;
• Delete your account and all associated data in accordance with our Privacy Policy;
• Cancel any pending orders in connection with account termination, subject to applicable refund obligations;
• Take any other action we deem necessary to protect the Platform and its users from harm.

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations incurred prior to the termination date, including payment obligations for orders already placed.

Upon termination, all licenses and rights granted to you under these Terms shall immediately cease. Sections of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law provisions — shall survive indefinitely.

15. Changes to These Terms

Jet's Pizza reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email at the address associated with your account or through a prominent notice on the Platform.

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of the revised Terms. The invalidity or unenforceability of any particular provision shall not affect the validity or enforceability of any other provision of these Terms. Any invalid provision shall be replaced by a valid provision that most closely reflects the original intent of the severed provision and the overall spirit of these Terms.

17. Entire Agreement and Waiver

These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or guidelines published by Jet's Pizza on the Platform, constitute the entire agreement between you and Jet's Pizza with respect to your use of the Platform and supersede all prior and contemporaneous agreements, understandings, negotiations, and representations, whether oral or written, between the parties relating to the subject matter herein.

No waiver by Jet's Pizza of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default, and shall not affect any other rights or remedies available to Jet's Pizza. These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Jet's Pizza. You may not assign or transfer your rights under these Terms without our prior written consent. Jet's Pizza may freely assign its rights and obligations under these Terms without restriction.

18. Force Majeure

Jet's Pizza shall not be held liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor strikes, governmental restrictions, power outages, internet service failures, civil unrest, or other events of force majeure. In such cases, we will use commercially reasonable efforts to resume normal operations as promptly as practicable.

19. Electronic Communications and Notices

By using the Platform and providing your email address, you consent to receive electronic communications from Jet's Pizza, including order confirmations, service updates, and promotional messages (where you have opted in). You agree that all notices, disclosures, and other communications that we provide electronically shall satisfy any legal requirements that such communications be in writing.
